Terms of Service

Welcome to Mindy. These Terms of Service ("Terms") govern your use of the Mindy website and the Mindy Program (together, the "Service"). By using the Service or texting our number, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

The Mindy Program includes two separate kinds of services, delivered by phone, text message, video, and, for local clients who choose the hybrid option, in person.

1. Mindy Software and Navigation Services

"Navigation Services" means:

Our HIPAA-secure portal and access for the family members you invite
Document consolidation, such as wills, powers of attorney, and medical records shared with your loved one's permission
Task tracking and reminders
General education and information
Administrative research, such as finding providers, services, resources, or benefits your loved one may qualify for
Coordination, such as arranging services, preparing forms, summaries, and follow-ups

Navigation Services are delivered using software, including AI tools. They are not nursing or medical services. Information you receive through Navigation Services is general and is not an individualized health assessment.

2. RN Professional Services

"RN Professional Services" are provided by a registered nurse licensed in Pennsylvania and include:

Individualized nursing assessment
Health education and counseling
Care planning within a registered nurse's scope of practice
Documentation
Escalation protocols
Referrals back to physicians or to emergency care

RN Professional Services are included in the Mindy Program, including the intake with your loved one and the care plan. They are currently available only for loved ones who live in Pennsylvania. They are provided for your loved one, so we need consent from your loved one, or from someone legally authorized to act for them, before we provide them.

Limits of our services

Our nurse does not diagnose medical conditions, prescribe medications, or replace your loved one's physicians or other care providers. When something is outside a registered nurse's scope, or needs a physician, we will tell you and refer you. Mindy does not provide legal or financial advice. Always consult a qualified professional for legal or financial decisions.

Using Navigation Services alone does not create a nurse-client relationship. That relationship starts only when you enroll in the Mindy Program and we have the consent described above.

In an emergency, call 911 or your local emergency number. Mindy is not an emergency service and cannot respond to emergencies.

The Service may change or be discontinued at any time.

Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement.

Text messaging terms & consent

By texting our number, (484) 562-4909, you consent to receive text messages from Mindy related to your inquiry and the Service, including proactive check-ins. Consent is not a condition of any purchase.

Message frequency varies. Message and data rates may apply according to your mobile carrier and plan. You are responsible for any charges from your carrier.

Reply STOP at any time to unsubscribe; you will receive one confirmation message and then no further texts unless you opt back in. Reply HELP for help. Supported carriers are not liable for delayed or undelivered messages.

We handle your messaging information as described in our Privacy Policy. We do not sell your information or share your mobile opt-in data with third parties for their marketing.

Getting Started plans

Most families start with one task, chosen on our start page. Its price is shown before you send your request.

When you pay. You pay when you book your first call, through our payment processor, Stripe.
Refunds. You get a full refund if you cancel before our first call.
If we can't help. If your request is outside what we can do, for example because your loved one lives outside Pennsylvania, we'll tell you, and you won't be charged. If you've already paid, we'll refund you in full.
The free call. If you aren't sure where to start, your first call, to pick the first task, is free.
Providers we suggest. Mindy takes no money from the providers we suggest. They are independent businesses, and any agreement for their services is between you and them. We don't guarantee their availability, prices, or quality.

Pilot program

Mindy is in an early pilot. Features may change as we learn what helps families most.

Your responsibilities

Provide accurate information and use the Service lawfully.
Do not misuse the Service, attempt to disrupt it, or use it to harm others.
Only share information about another person (such as an aging parent) that you have the right to share.

Intellectual property

The Service, including its content, branding, and software, is owned by Mindy and protected by applicable laws. You may not copy, modify, or distribute it without our permission.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, and Mindy is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Continued use of the Service means you accept the changes.
